Legal facts
- 18 U.S.C. § 1029 covers fraud and related activity with access devices. Selling, transferring, or possessing card numbers with intent to defraud falls under it.
- Penalties under § 1029 run up to 10 years for a first offense and up to 15 years for repeat offenses. Use of the data to obtain more than $1,000 in a year raises the maximum to 15 years.
- Telegram is a messaging platform. It does not operate card markets. Channel operators are third parties.
- Card networks and issuers monitor for card-not-present fraud. Issuers can reverse charges and close accounts.
